1. Scope

1.1. These General Terms and Conditions apply to contracts between FINSTERECK KG and consumers for goods, in particular those ordered via our online shop.

1.2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

1.3. For contracts with entrepreneurs, our separate General Terms and Conditions for entrepreneurs (B2B) apply.

1.4. The version of these General Terms and Conditions in effect at the time of the order shall apply.

2. Conclusion of the contract

2.1. The presentation of our products in the online shop does not yet constitute a binding offer to conclude a purchase agreement.

2.2. By submitting the order, the customer makes a binding offer to purchase the goods contained in the shopping cart.

2.3. An automatically sent confirmation of receipt of the order merely confirms receipt of the order and does not yet constitute acceptance of the offer.

2.4. The contract is concluded when FINSTERECK KG expressly accepts the order, in particular by means of an order or shipping confirmation, or dispatches the ordered goods.

2.5. If we are unable to accept an order, the customer will be informed. Any payments already made will be refunded in this case.

3. Prices and shipping costs

3.1. The prices stated in the online shop for consumers are in euros and include statutory VAT.

3.2. Additional shipping costs may apply. The applicable shipping costs are displayed on the Payment & Shipping page and during the ordering process.

3.3. For deliveries to countries outside the European Union, additional customs duties, import taxes, or other public charges may apply. These are not collected by FINSTERECK KG and must be borne by the recipient in accordance with the regulations of the respective country of destination.

4. Payment

4.1. The following payment methods are currently available in the online shop:

Visa · Mastercard · PayPal · Prepayment / Bank Transfer

4.2. The payment methods actually available for the respective order will be displayed during the ordering process.

4.3. In the case of payment in advance, shipping will take place after receipt of the full invoice amount, unless otherwise stated for the respective product.

4.4. If a payment service provider is used, its terms and conditions for payment processing may also apply.

5th delivery

5.1. Delivery will be made to the delivery address specified by the customer during the ordering process.

5.2. The applicable delivery time is indicated with the product or in the online shop.

5.3. If several goods are part of an order, they can be delivered separately, provided this is reasonable for the customer.

5.4. In the case of consumers, the risk of accidental loss or accidental damage to the goods generally only passes to the consumer upon delivery of the goods to the consumer or a third party designated by him.

5.5. Any obvious transport damage should be documented with the delivery driver and reported to us, if possible. Failure to report such damage does not limit the consumer's statutory warranty rights.

6. Retention of title

The delivered goods remain the property of FINSTERECK KG until the purchase price has been paid in full.

7. Right of withdrawal / cancellation

7.1. Consumers generally have the right to withdraw from distance contracts within 14 days without giving any reason.

7.2. Details regarding the start and duration of the withdrawal period, the exercise of the right of withdrawal, the consequences of withdrawal and statutory exceptions can be found in our separate cancellation policy.

7.3. There we also provide the legally required sample cancellation form.

7.4. For distance contracts concluded via our online user interface, the electronic function "Cancel contract" is also available during the statutory withdrawal period.

7.5. The consumer can use this function to declare their withdrawal electronically. After submitting the declaration, they will immediately receive an electronic confirmation of receipt containing the content of their declaration as well as the date and time of receipt.

7.6. The use of the online cancellation function is not a prerequisite for a valid cancellation. Cancellation can also be declared in any other legally permissible way.

8. Returns after a cancellation

8.1. After a valid cancellation, the goods must be returned or handed over immediately and at the latest within 14 days of the declaration of cancellation.

8.2. The consumer shall bear the direct costs of the return shipment.

8.3. Details regarding returns and refunds can be found in our cancellation policy.

8.4. The consumer is only liable for any loss in value if this is due to handling that is not necessary for testing the nature, characteristics and functioning of the goods.

9. Statutory Warranty

9.1. For consumers, the statutory warranty provisions apply, in particular the provisions of the Austrian Consumer Warranty Act (VGG).

9.2. For goods, we generally provide a warranty for defects that are present at the time of delivery and that appear within two years after delivery.

9.3. The consumer is entitled to the statutory warranty remedies.

9.4. The statutory warranty rights are not limited by these General Terms and Conditions.

9.5. A voluntary warranty exists only if it is expressly stated for the respective product. Such a warranty does not affect the statutory warranty rights.

10. Product information and intended use

10.1. The specifications in the respective product description are decisive for the condition of the goods.

10.2. Minor deviations in the presentation, in particular due to different screen or color settings, do not constitute a defect, provided that the actual quality of the goods is not affected.

10.3. The operating, safety and care instructions for the respective product must be observed.

10.4. Damage that occurs only after delivery and solely due to improper or unintended use does not give rise to a warranty claim for a product that was free of defects at the time of delivery.

11. Liability

The statutory provisions apply to claims for damages.

Mandatory statutory liability provisions, in particular liability for personal injury and claims under product liability law, are not limited by these General Terms and Conditions.

12. Ordering process and contract language

12.1. The contract language is German.

12.2. Before submitting the order, the customer can check and correct his information and the products in the shopping cart.

12.3. The General Terms and Conditions can be viewed and saved on our website before completing the order.

12.4. The order information relevant to the contract will be made available to the customer electronically in connection with the order.

13. Data Protection

Information on how FINSTERECK KG processes personal data can be found in our separate privacy policy.

14. Alternative Dispute Resolution

FINSTERECK KG is currently neither legally obligated nor voluntarily obliged to participate in proceedings before an alternative dispute resolution body.

If a dispute arises with a consumer in an individual case for which no immediate agreement can be reached, we will inform the consumer, in accordance with legal requirements, about the competent body for alternative dispute resolution and whether we are participating in any proceedings.

15. Applicable Law

15.1. Austrian law applies.

15.2. For consumers whose habitual residence is in another state, this choice of law does not affect the protection afforded to them by mandatory provisions of the law of their habitual residence state.

15.3. Mandatory directly applicable law of the European Union remains unaffected.

15.4. The statutory provisions apply to judicial jurisdiction.

16. Final Provisions

Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the remaining provisions shall remain unaffected in accordance with the statutory regulations.

In place of an ineffective provision, the applicable statutory regulations shall apply.
